These Terms & Conditions ("Terms") govern your access to and use of devinaireclothing.com (the "Site") and the purchase of any products from Devinaire Clothing Company, a trade name of Modicum & Fuscus Holdings ("Devinaire," "we," "us," or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

4. Products, Pricing, and Availability
All products are subject to availability and may be withdrawn at any time. Prices are displayed in U.S. dollars unless otherwise indicated and exclude applicable taxes, duties, and shipping unless stated. We make every effort to display colors, finishes, and details accurately, but actual appearance may vary based on your device. We reserve the right to correct pricing errors, limit order quantities, refuse or cancel orders, and discontinue products at any time without prior notice.
5. Orders and Payment
Your order constitutes an offer to purchase, which we may accept or decline. A binding contract is formed only when we send a shipping confirmation. We accept major credit and debit cards and other payment methods displayed at checkout. By submitting payment information, you represent that you are authorized to use the payment method. We may verify orders before processing and may cancel any order suspected of fraud.
6. Shipping, Risk of Loss, and Title
Estimated delivery times are provided in good faith but are not guaranteed. Title and risk of loss pass to you upon delivery to the carrier. International customers are the importer of record and are responsible for any applicable duties, taxes, and customs fees not collected at checkout.
7. Returns and Refunds
Unworn merchandise with original tags attached may be returned within 30 days of delivery in accordance with our Returns Service policy. Final sale, intimate, and altered items are not eligible for return. Refunds are issued to the original payment method within 10 business days of receipt and inspection of the returned merchandise.
8. Intellectual Property
All content on the Site — including text, graphics, photographs, video, logos, designs, garment silhouettes, and the "Devinaire" name and marks — is owned by or licensed to Modicum & Fuscus Holdings and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content without our prior written consent.
9. User Conduct
You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the Site or its systems; (c) interfere with the Site's operation or security; (d) use bots, scrapers, or automated tools without our written permission; (e) submit false or misleading information; or (f) infringe the rights of any third party.

By submitting reviews, photographs, comments, or other content to the Site, you grant Devinaire a worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, publish, and display such content in connection with our business. You represent that you own or control all rights to the content you submit.

12. Disclaimers
THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT AS REQUIRED BY APPLICABLE LAW. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MODICUM & FUSCUS HOLDINGS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCT. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Maryland, United States, without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Carroll County, Maryland, and you consent to personal jurisdiction in those courts. Where permitted, you waive any right to a jury trial and to participate in any class action.
16. Changes to These Terms
We may update these Terms at any time. The updated version is effective upon posting to the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
17. Severability and Entire Agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Devinaire regarding the Site.
